18 USC Chapter 11A
This law makes it a federal felony offense on interstate cases if the nonpaying parent is $10,000 behind in payments or does not pay for two years.
It is a federal felony crime.
If the nonpaying parent is found guilty they can be sentenced one - five years in a federal prison. Often they are placed on probation and given a payment plan to meet. If they fail to make payments as required under the probation order they can then be sent to jail. This provides the family owed support a strong tool to force regular payments.
It is difficult to get the U.S. Attorney to file misdemeanor charges due to insufficient staffing in U.S. Attorney Offices throughout the country. The Federal Office of Child Support has established offices to review case and refer them on to the U.S. Attorney to try to ensure that as many case as possible get prosecuted.
