Question:
I've tried over the past 5 years to implement a child support order in the court system in Memphis, TN. First, there was a mix up on one of my
kids names, changed at birth. The hospital record has one name, but on the birth certificate his real name appears. This one mix-up has held me back. I finally got a
Affidavit that he signed, stating that our child's name is what's shown on the birth certificate, not on the hospital record. It was signed and notarized. I was told
by the child support people that I needed this affidavit, before an interstate claim could be filed.
History of the case: When our court date came up in Memphis, he did not appear (he lives in Louisville, KY). So, when he didn't show up, nothing
happened to him. They told me to file an interstate claim. When I tried to do this they said that the name change was a problem.
It's about 7 years later now. I'm struggling with 2 boys, ages 11 and 9. I've recently tried to take on a 2nd job, which is not fair, when he
won't work 1 job and pay for his kids.
What can I do to get him to pay child support from Kentucky. How do I do this with the name change issue?
Please help. I've got a chronic illness (sickle cell disease) so I definitely do not need to work 2 jobs, living with chronic pain
everyday.

Answer:
If the non-paying parent lives in a state different from where the custodial parent and children live, you can request the government child
support agency to do:
1. Interstate income-withholding if the employer of the non-paying parent is known (mandatory if the non-paying parent is one month behind in
payments).
2. Or use UIFSA (Uniform Interstate Family Support Act) to establish paternity and an order or to enforce an order.
3. Ask the County Prosecutor to file Criminal Non-Support Charges under State Law
4. Ask the U.S Attorney to file Criminal Non-Support Charges under Federal Law

After your case has been sent to the state where the non-paying parent lives, be sure to contact that state's
child support agency and make sure they have all information needed and that they are taking action.
