Ask The Child Support Expert

Question: My ex boyfriend is the father of my 9 year old daughter. He used to pay child support when she was 3 twen he worked side jobs. Now he is on SSI (Social Security Supplemental Insurance). I was told I should get child support, but I do not, is there anyone who can help me find out if I can get child support. Thank You

Answer: Write your US Congressman and and US Senator to complain that when someone receives SSI ( Social Security Supplemental Insurance) their children suffer because they do not get a dependent benefit like children of parents who receive SSD ( Social Security Disability ). This is not fair and not the child's fault, it is bad public policy.

Also, ask your government child support agency or attorney to file a contempt of court motion and ask the court to order him to apply for SSD. Social Security Supplemental Insurance (SSI) is designed to be for short term disability, if his disability is permanent, he might qualify for SSD and you child would receive a dependent benefit. He would have had to work in the past and pay into the Social Security System to qualify, more information here http://www.ssa.gov/dibplan/dqualify.htm
